Do You Need a Council Permit for a Skip Bin? A Guide for Sydney’s South

If you’re hiring a skip bin for a renovation, cleanout, or building job, there’s one question that catches a lot of people off guard: do I actually need a council permit for this?

The short answer? It depends on where the bin goes, not what’s in it.

Here’s the simple rule: if your skip bin stays entirely on your own property (your driveway, front yard, or any hard surface within your boundary), you don’t need a permit. No paperwork, no fees, no waiting.

But if the bin needs to go on a nature strip, the road, a footpath, or any other council-managed land, you’ll need to apply for a permit before it’s delivered.

This applies across all of our service areas: Sutherland Shire, St George, Bankstown, and the Eastern Suburbs. Each council has its own application process, fees, and rules, and they do vary quite a bit. We’ve pulled together the key details below so you know exactly what to expect.

When Do You Need a Permit?

A council permit is required any time a skip bin is placed on public land. Under Section 68 of the NSW Local Government Act 1993, councils have the authority to approve (or refuse) the placement of waste storage containers on their land.

You need a permit if the bin will be on:

The nature strip in front of your property

The road or street

A footpath or any council-controlled space

Even if the bin is on your property but overhangs onto public land

You don’t need a permit if the bin will be on:

  • Your driveway
  • Your front or back yard
  • Any area fully within your property boundary

Most of the time, customers place their skip in the driveway and don’t need a permit at all. But if you’re short on space, or your driveway is too steep, too narrow, or blocked, you may need to use the nature strip or road. That’s when the permit comes in.

How to Apply for a Skip Bin Permit

The process is similar across most Sydney councils, but each one has its own form and requirements. 

Here’s the general step-by-step:

Check if you really need one. If there’s any way to fit the bin on your property, you can skip (pardon the pun) the whole process.

Contact your local council or visit their website. Most councils have a downloadable application form, and some let you apply online.

Fill out the application with details like:

– Your name and contact details

– The address where the bin will be placed

– The dates you need the bin (placement and removal)

Submit and pay the fee. Most councils require payment upfront before the permit is issued.

Wait for approval. Allow at least 5 working days. Some councils take longer.

Once approved, the bin can be delivered.

The Eastern Suburbs covers several councils, and fees vary significantly:

Council fees change from year to year. The figures above were current at the time of writing. Always check directly with your council for the latest fees before applying.

Placement Rules You Need to Know

Once you’ve got your permit, you can’t just drop the bin anywhere on the street. Every council has placement conditions, and most of them are pretty consistent. They may include:

  • 3-metre clearance must be maintained on the road so vehicles can pass safely
  • The bin must be placed parallel to the kerb, not sticking out into traffic
  • It can’t block driveways, pedestrian footpaths, or access points
  • It must be positioned away from intersections (usually 10 to 20 metres depending on the council)
  • Not near bus stops, fire hydrants, or disabled parking spaces
  • Reflective tape is required on all bins placed on public land. This is for visibility at night
  • In poorly-lit areas, flashing yellow lights may also be required
  • Georges River Council specifies bins must be painted in RMS (Roads and Maritime Services) -approved colours and display the supplier’s name and 24-hour contact number
  • These rules are about safety, for you, your neighbours, and anyone using the road. They’re not hard to follow, and your skip bin provider should be across all of them.

What Happens If You Don’t Get a Permit?

Placing a skip bin on public land without a permit isn’t just a grey area. It’s an offence under the Local Government Act 1993.

Here’s what can happen:

  • Fines. Maximum penalties of up to $2,200 for individuals under the Local Government Act 1993, with amounts varying by council and breach
  • Forced removal. The council can order the bin removed immediately, and the cost comes back to you (the hirer)
  • Impounding. In some areas, the council can impound the bin and charge you for removal, transport, and storage on top of the fine
  • It’s not worth the risk, especially when permit fees are relatively low (from as little as $42 in the Sutherland Shire for a 2-day placement).

Tips to Avoid Needing a Permit

If the permit process sounds like a hassle, the good news is that most of our customers don’t need one. Here are a few tips:

Use your driveway. Even a single-car driveway can usually fit a 2m³ or 3m³ skip bin comfortably.

Temporarily move a car. If your driveway is occupied, parking the car on the street for a few days frees up space for the bin.

Clear a spot in the front yard. A bin can sit on grass, pavers, or any flat surface within your property boundary. If you’re worried about protecting your lawn, we can place boards underneath.
